1. Scope of Application

1.1 These Terms and Conditions apply to all orders placed via the online platform FLUGPOST.art (hereinafter referred to as “Seller”) by consumers or business customers (hereinafter referred to as “Customer”).

1.2 Custom-made artworks, print-on-demand editions, and digital content are also subject to these Terms and Conditions unless expressly agreed otherwise.

1.3 Books and pre-produced artworks (“Archive Sale”) are also part of the offer and are subject to special withdrawal regulations (see Section 3).

1.4 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business customer is any natural or legal person acting in the course of their commercial or self-employed activity.

2. Conclusion of Contract

2.1 The products presented in the online shop do not constitute a legally binding offer, but an invitation to submit a purchase offer.

2.2 A purchase contract is concluded only when:

  • the Customer completes an order and confirms payment, and

  • the Seller confirms the order by email or dispatches the goods.

2.3 If an order cannot be accepted (e.g. due to technical errors or lack of availability), the Customer will be informed.

2.4 Payments via PayPal, Stripe, Klarna / Sofort or other providers are subject to the respective terms and conditions of those payment service providers.

3. Right of Withdrawal

3.1 No Right of Withdrawal for Custom Products

The right of withdrawal does not apply to:

  • Print-on-demand artworks (editions, canvas products, and similar items)

  • Individually customized artworks based on customer specifications (size, material, motif, etc.)

As these products are produced specifically for the Customer, cancellation or return is excluded.

3.2 Right of Withdrawal for Books & Archive Sale

Books and Archive Sale artworks may be returned within 14 days after delivery.

The withdrawal period begins on the day of delivery.

4. Prices & Payment Conditions

4.1 All prices are final prices including statutory VAT. Shipping costs are calculated separately and displayed during checkout.

4.2 For orders outside the EU, additional charges (customs duties, taxes) may apply and must be borne by the Customer.

4.3 Available payment methods:

  • PayPal

  • Credit Card (Stripe)

  • Bank Transfer

  • Klarna / Sofort

5. Shipping & Delivery

5.1 Delivery is made to the address provided by the Customer. For PayPal payments, the PayPal delivery address is used.

5.2 If delivery fails due to incorrect address details or absence of the recipient, the Customer bears the resulting costs.

5.3 Digital content is provided as a download or by email after payment has been received.

6. Usage Rights for Digital Content

6.1 Upon purchase, the Customer receives a non-transferable right to use the digital content.

6.2 Any distribution, reproduction, or commercial use without express written permission of the Seller is prohibited.

6.3 The usage license becomes effective only after full payment.

7. Retention of Title

The goods remain the property of the Seller until full payment has been made.

8. Warranty / Defects Liability

8.1 Statutory warranty rights apply.

8.2 Transport damage must be reported within 10 days after receipt, including photographic documentation, to enable prompt clarification.

9. Special Conditions for Custom-Made Artworks

9.1 Custom-made artworks, print-on-demand editions, or canvas prints are excluded from the right of withdrawal, as they are produced individually for the Customer.

9.2 If a custom product arrives damaged, a replacement will be arranged by mutual agreement.

10. Redemption of Vouchers

10.1 Gift vouchers can be used for all products in the shop and are valid for three years.

10.2 Promotional vouchers are time-limited and may be restricted to specific products or campaigns.

10.3 Cash payment of voucher values is excluded.

11. Applicable Law

The law of the Federal Republic of Germany shall apply.
For international orders, mandatory consumer protection regulations of the Customer’s country remain unaffected.

12. Code of Conduct

The Seller commits to fair and transparent business practices in accordance with EU consumer protection regulations.

13. Alternative Dispute Resolution

13.1 The European Commission provides a platform for online dispute resolution (ODR):

13.2 The Seller is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
